Asbestos

FEDERAL

All asbestos rules, guidelines, regulation, and enforcement commence at the federal level. Every state must adhere to asbestos laws, meeting at least the federal requirements. The administration of these laws involves several agencies, with the Environmental Protection Agency (EPA) and the Occupational Safety and Health Administration (OSHA) serving as the primary regulators.

STATE

Every state is tasked with enforcing federal asbestos laws and regulations. States have the option to implement additional rules and regulations, provided they meet or surpass the federal standards. Many states have specific regulations concerning asbestos testing, clearance, and abatement. It's crucial to familiarize yourself with both your state's laws and federal regulations before undertaking any asbestos-related activities.

LOCAL

In addition to federal and state laws and regulations, local cities, counties, and air resource boards may also enact additional provisions. The agencies responsible for oversight rigorously enforce these provisions. Be sure to contact your local environmental consultant such as RegasGroup prior to engaging in any asbestos related activities.

EPA helps regulated entities meet federal requirements and holds entities legally accountable for violations. EPA issues guidance documents to further clarify and assist in implementation of regulations
OSHA | Occupational Safety and Health Administration
OSHA oversees the working conditions for U.S. workers by implementing and managing occupational safety and health standards. The following regulations pertain to handling asbestos in the workplace.
NIST | National Institute of Standard Technology
The NVLAP Asbestos Fiber Analysis program provides assurance thatlaboratories are competent to analyze asbestos samples using polarized light microscopy (PLM) and/or transmission electron microscopy (TEM).
CDC | Center for Disease Control and Prevention
The CDC oversees the National Institute for Occupational Safety and Health(NIOSH)and NIOSH manual of Analytical Methods (NMAM).

EPA’s Pacific Southwest (Region 9) implements and enforces federal environmental laws in Arizona, California, Hawaii, Nevada, the Pacific Islands, and 148 tribal nations.
DIR | State of California Department of Industrial Relations
The DIR oversees the asbestos DOSH unit, better known as Cal/OSHA. The Division of Occupational Safety and Health (DOSH), better known as Cal/OSHA, protects and improves the health and safety of working men and women in California.

Materials that contain more than 1/10th of 1% asbestos by weight trigger the Cal/OSHA asbestos registration requirements over 100sf of material at a single job site.

California Health and Safety Code section 39658(b)(1) establishes theAsbestos National Emissions Standards for Hazardous Air PollutantsNESHAPas an airborne toxic control measure.AsbestosNESHAP protects the public and environment by minimizing the release of asbestos fibers during renovation and demolition activities.
CSLB | California Contractors State License Board
The Contractors State License Board protects consumers by regulating the construction industry through policies that promote the health, safety, and general welfare of the public in matters relating to construction.
